1. Acceptance of Terms

By accessing this website or booking services with Sweet Jean Photography, you agree to the following Terms & Conditions. If you do not agree with these terms, please refrain from using this website or booking services.

2. Intellectual Property

All content on this website — including images, text, graphics, branding, logos, and design — is the property of Sweet Jean Photography and is protected by United States copyright law.

No content may be copied, reproduced, distributed, modified, downloaded, or used for commercial purposes without prior written permission.

Unauthorized use of images is strictly prohibited.

3. Booking & Payments

All photography sessions require:

  • A signed agreement
  • Payment of the session fee or retainer

Session fees are non-refundable unless otherwise stated in your individual session contract.

Specific rescheduling, cancellation, and payment terms are outlined in your signed agreement and supersede this website policy where applicable.

4. Photography Sessions

Sweet Jean Photography offers studio, in-home, and select outdoor photography sessions. Session details, timing, and preparation guidelines are provided during the booking process.

Clients are responsible for arriving on time and prepared for their session. Session start times may not be extended due to late arrival.

5. Photography Events & Limited Sessions

Seasonal events and limited offerings — including but not limited to the Motherhood Event, Santa Sessions, and other promotional or themed sessions — may have specific booking terms provided at registration.

Due to the limited nature of these events:

  • Session fees are non-refundable
  • Time slots are not guaranteed transferable
  • Artwork or image quantities are defined at the time of booking

Event-specific terms outlined at registration govern those sessions.

6. Collective Membership

The Collective Membership is governed by a separate signed agreement outlining:

  • Membership duration
  • Session scheduling
  • Included benefits or artwork credits
  • Payment structure
  • Cancellation terms

Membership benefits must be used within the agreed term unless otherwise specified in writing. Unused sessions or benefits may be forfeited if not completed within the membership period, as outlined in the signed agreement.

7. Image Ownership & Usage

All photographs created by Sweet Jean Photography remain the intellectual property of the photographer.

Clients receive personal-use rights to purchased digital images. Personal use includes printing, sharing with family and friends, and posting on personal social media accounts.

Images may not be:

  • Edited, filtered, or altered
  • Submitted to contests
  • Used for commercial purposes
  • Resold or redistributed

Commercial usage requires written licensing agreement.

8. Model Release

Unless otherwise agreed in writing prior to the session, Sweet Jean Photography reserves the right to use images for portfolio display, website use, marketing materials, studio samples, and social media.

Clients may request privacy in writing before their session.

9. Artwork & Product Orders

All artwork, albums, prints, and custom products are made to order.

Due to the custom nature of photographic artwork:

  • All sales are final
  • Refunds are not provided once production has begun

If a product arrives damaged or defective, notification must be made within 7 days of delivery so that replacement arrangements can be made.

10. Digital Image Storage

While Sweet Jean Photography takes reasonable steps to archive digital files, long-term storage is not guaranteed.

Clients are responsible for backing up all delivered digital files. We recommend maintaining multiple backups to protect your investment.

11. Limitation of Liability

Sweet Jean Photography is not liable for:

  • Personal injury sustained during sessions
  • Property damage during on-location sessions
  • Uncontrollable circumstances including weather, illness, natural disasters, or technical failures

In the unlikely event of total photographic failure or loss, liability is limited to the amount paid for the session.

12. Website Use

You agree to use this website for lawful purposes only and not to attempt to disrupt or interfere with its functionality.

13. Governing Law

These Terms & Conditions are governed by the laws of the State of California.

Any disputes arising from services or website use shall be resolved in the appropriate courts of California.

14. Changes to These Terms

Sweet Jean Photography reserves the right to update these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date.
